a.        WORK TRAINING CENTER Use Permit Modification (PL12-00006) Application requesting to modify the terms and conditions of a previously approved use permit (modification of requirements for the timing of public street frontage improvements) for property located at 7837 Skyway, Paradise, AP No. 051-163-039.

Early this morning, January 23, 2012, 1:30 AM, a report was forwarded to Paradise Public Works officials that the signal at the intersection of Skyway and Pearson Road was not operating correctly. Upon investigating it was determined that there was a malfunction of the left turn lighting. Maintenance personnel were brought in to isolate the problem and perform repairs. Upon arrival it was determined that several things had occurred and that the proper parts were not available for repairs.

The Town of Paradise, as well as most of northern California, had very active weather for the past 5 days. The rainfall totals for Paradise alone was in excess of 10 inches. The National Weather Service has dropped the Hazardous Weather Outlook Statement for our area and the forecast for the next 5 days includes only some light rain and showers between Tuesday, January 24 and Thursday January 26, 2012.

The Town of Paradise, as well as most of northern California, has a very active weather forecast for the next seven days. The National Weather Service has issued a Hazardous Weather Outlook Statement warning of the potential for heavy rain over the next seven days.  Foothill locations such as Paradise could easily see 6 inches or more of rain in the period from Wednesday into early next week.

The Paradise Town Council is inviting applications for volunteers who live in Paradise to serve on the Tree Advisory Committee.  The committee convenes on a needs only basis at the request of the Town Council, Planning Commission or staff and is charged with duties designated and delegated by the Town Council on matters pertaining to the management of tree resources within the town.  The committee also serves as a forum for the coordination of tree-related policies, and advises the town on matters referred by Town departments, or by a majority vote of the Planning Commission or the Town Council.

PG&E will be Repairing the Paradise Substation which will impact the power throughout Paradise.  Please be prepared to be without service on Saturday, December 10, 2011, starting at 11:45 PM and continuing through Sunday, December 11, 2011 at 4:00 AM, a period of 4.25 hours (weather permitting).

The outage will also affect the signalized intersections in Paradise which will be without power. According to the California Vehicle code, “the driver of any vehicle approaching an intersection which has official traffic control signals that are inoperable shall stop at the intersection, and may proceed with caution when it is safe to do so.”

NOTICE IS HEREBY GIVEN by the Town of Paradise Planning Director that a public hearing will be held on Monday, December 12, 2011 at 10:00 a.m. in the Town Council Chambers at Paradise Town Hall, 5555 Skyway, Paradise, CA, regarding the following project:

     ARC OF BUTTE COUNTY Use Permit (PL11-00331): Application proposing to establish a community care facility (adult day care) for up to 45 adults with developmental disabilities within an existing +/-3,500 square foot vacant office building on property located at 5325 Black Olive Drive, AP No. 052-250-062.

Notice Inviting Bids

The Town of Paradise will be accepting three separate bids for the following public works  projects:

1.      HVAC Replacement at Town Hall, Police Department and Vehicle Maintenance, consisting of removal and replacement of eight (8) HVAC units at various locations

2.      Fluorescent Lighting Conversion at the Town Hall, Police Department, Fire Station #1, #2 and the Street Maintenance Corporation Yard office, consisting of conversion of a total of one-hundred fifty-five (155) 48” long 2-bulb T12 light fixtures to T-8 light fixtures; and, conversion of four (4) exterior light fixtures to LED at Town Hall.

3.      Safety Lighting Conversion at signalized intersections in the Town of Paradise, consisting of the conversion of forty-seven (47) High Pressure Sodium safety lights at fourteen (14) signalized intersections to LED. This work is to be performed under the supervision of the Town of Paradise Traffic Signal Maintenance Contractor, Republic ITS. All installation inspection costs for this portion of work to be included in contractors bids.  

Successful lowest responsible bidder will be required to prepare cost breakdowns by November 29^th for: Equipment/Material Cost per unit and Non-Equipment Cost per unit.    

The Town of Paradise will receive sealed bids for the above three individually bid public works project at the Office of the Town of Paradise, Town Clerk, 5555 Skyway, Paradise, CA 95969, until 2:00 PM, (PST), November 22, 2011, at which time they will be publicly opened and read aloud.  The envelope enclosing the bid submittal shall be clearly marked “Bid for …” followed by the title of this project, specific project and the date and hour for opening of bids.

NOTICE IS HEREBY GIVEN that the Town Council of the Town of Paradise will conduct a public hearing on Tuesday, November 8, 2011 at 9:00 a.m., or as soon thereafter as possible, in the Town Hall Council Chambers, 5555 Skyway, Paradise, California regarding the following matter:

PARADISE COMMUNITY VILLAGE MITIGATION MEASURE AMENDMENT REQUEST (PL09-00106): Town Council consideration of a Planning Commission recommendation to adopt a resolution to amend several mitigation measures contained within the environmental documents prepared and certified in 2007 for a mixed-use planned development project approved by the Town in 2009. If approved by the Town Council, the modification request would result in the implementation of an alternative formula for calculating traffic mitigation fees for the project, but is not intended to result in an overall reduction or elimination of the required fees.  The +/-48.38 acre project site, zoned Community Services/Planned Development (CS/PD), is located at the west end of Village Parkway in Paradise and is further identified as Assessor Parcel Nos. 054-380-001 and 002. 

The Town of Paradise maintains about 100 centerline miles of roadway, with about 80 miles of roadway striping (centerlines and lane/edge lines).

Since traffic (and winter snow plowing/ sanding activity) wears the paint away, the Town of Paradise’s Public Works Division in conjunction with Butte County Public Works Department plan to start centerline stripes and lane lines operations on the most heavily traveled roadways each year. Road striping must be done when the road surface is dry and the weather is relatively warm.

Work will begin the week of October 10, 2011 and continue through the beginning of November 2011 (weather permitting).  Our goal this fall is to complete the re-striping of most of the major roads in the Town as well as some of the secondary road shown on the attached list.

NOTICE IS HEREBY GIVEN by the Town Council of the Town of Paradise that a public hearing will be held on Tuesday, August 2, 2011 at 6:00 p.m., or as soon thereafter as possible, in the Town Hall Council Chambers, 5555 Skyway, Paradise, California regarding the following matter: To consider introducing a proposed ordinance relating to restricting medical marijuana cultivation, processing, and distribution.

The proposed ordinance provides, among other things, as follows:

1. Qualified patients or primary caregivers would be allowed to cultivate no more than 50 square feet of medical marijuana within a residential zoning district, in a rear or side yard with certain setbacks from adjacent properties.

2. Indoor cultivation by qualified patients or primary caregivers in a residential zoning district would be allowed only with a permit issued by the Planning Director based on specific criteria.

3. All marijuana cultivated on residential property would be for the personal use of the qualified patient residing on the property.

4. Cooperative/collective medical marijuana cultivation, processing and distribution facilities would be allowed only in the Industrial Services (IS) Zoning District with a permit issued by the Planning Director based on specific criteria and operating standards relating to such facilities. The hours of operation would be limited to 8:00 a.m. to 6:00 p.m. daily. The permit would be renewed annually and nontransferable.

5. The permit for a cooperative/collective would be subject to revocation after a hearing before the Planning Director, which could be appealed to the Town Manager.

NOTICE IS HEREBY GIVEN by the Town Council of the Town of Paradise that on August 2, 2011, a public hearing as required by Section 147(f) of the Internal Revenue Code of 1986 will be held with respect to the proposed issuance by the California Municipal Finance Authority of its revenue bonds in one or more series in an amount not to exceed $5,500,000 (the “Bonds”).  The proceeds of the Bonds will be used to: (1) finance the acquisition, construction, improvement and equipping of a 36-unit multifamily rental apartment project in the Town of Paradise, California (the “Project”); and (2) pay certain expenses incurred in connection with the issuance of the Bonds.  A street address has not yet been assigned to the Project site, but the Project site is the 2.52-acre parcel known as Lot 1, as shown on the parcel map entitled "Paradise Community Village Phase I", recorded in the Office of the Recorder of the County of Butte on September 23, 2010, in Book 180 of Maps, at Pages 41-44, and is generally situated on the north side of Paloma Ave., approximately one-eighth of one mile south of Buschmann Road and one-eighth of one mile west of Clark Road in the Town of  Paradise, California.  All or a portion of the units in the Project will be occupied by persons or families of low or very low income.  The facilities are to be operated by Community Housing Improvement Program, Incorporated (“CHIP”), and are to be owned by a limited partnership to be formed at a later date, with CHIP as managing general partner.
