WHEREAS, under authority contained in California Government Code sections 8610 and 8634 and Paradise Municipal Code Chapter 2.40, the Town Council on November 13, 2018 declared the existence of a disaster in the Town of Paradise; and,

WHEREAS, I am empowered, upon proclamation of a disaster, to make and issue regulations on matters reasonably related to the protection of life and property as affected by such disaster; and

WHEREAS, on November 29, 2018, I, as the Director of Emergency Services, executed a Declaration imposing a curfew as a result of the Camp Fire; and

WHEREAS, under conditions of the disaster resulting from the Camp Fire, it is deemed necessary in the interest of public safety to restrict the use of certain public areas of the Town; and

WHEREAS, life and property are deemed to be in peril and speed is of the essence.

WHEREAS, it is necessary to amend the Declaration to reflect the change of season.

THEREFORE, I Lauren M. Gill, as Director of Emergency Services, hereby declare that a curfew be in effect starting at May 22, 2019 at 12:00 a.m., and during which no person shall be upon the public street, avenue, alley, park or other public place or unimproved public realty between the hours of 11 p.m. to 5:00 a.m. within the Town of Paradise.

This curfew shall not apply to police officers, peace officers, firefighters, utilities workers or other authorized emergency personnel or civilians engaged in police or emergency work, nor shall it apply to authorized representatives of any news service, newspaper or radio or television station or network.

          NOW, THEREFORE, BE IT DECLARED that the law enforcement forces of this Town, along with the law enforcement authorities cooperating with the Town, are hereby authorized and charged, to the extent provided by law, with the responsibility of enforcing this curfew and are further authorized to arrest such persons as do not obey this curfew after due notice, oral or written, has been given to said citizen. Any violation of this declaration shall be punished as provided in Section 2.40.100 of the Paradise Municipal Code.

          BE IT FURTHER DECLARED that this regulation shall remain in effect until such time as it is terminated by the Director of Emergency Services or the Town Council of the Town of Paradise.
