Business

The Town of Paradise issues business licenses to regulate businesses within the town limits to protect the public and prevent nuisances and neighborhood disturbances. The license is not a business tax and is not based on business revenue.
The Town’s objective is to assist each business in obtaining the proper license and/or permit to ensure proper compliance of the business license code for all businesses transacting businesses within Town limits. The Town will send renewal notices, however it is your responsibility as a business owner to renew. If you do not receive a renewal notice prior to the expiration date of your license, please contact the Clerk’s Department at (530) 872-6291 ext 101.

Cities and Counties control the way buildings are used in their jurisdictions in order to protect neighborhoods, encourage good development practices, and support property values. The Town of Paradise restricts certain business activities to buildings that have the correct structure for the activity.

The Town of Paradise Building Department also provides information to comply with the California Building Code, as well as the California Disabled Access requirements.

You need a Business License if your business is located within the Paradise Town Limits or if your business provides service to Paradise residents or businesses, unless your business is exempt from licensing requirements discussed below.

A Building Permit is required in most cases when you plan to make physical or cosmetic changes (electrical, mechanical, or plumbing installations or alterations) to the interior or exterior of the building you plan to occupy or if you are constructing a new building. A Building Permit is required when there is a change in the use of an existing space, such as putting a restaurant in what was a retail space.When a permit is required plans should be submitted for Plan Review and a Building Permit issued before starting any construction or remodeling. During the course of construction or remodeling, building inspectors are required to inspect the work performed.

You are required to obtain a business license before conducting any business, trade, profession, enterprise, establishment or occupation.

Before going to any public agency you should have an exact address for the proposed business. Having accurate site location is crucial for receiving the correct zoning and onsite septic information and for filing various documents and permits. Private mailbox addresses are for mailing purposes only and cannot be used as a business address.

Commercial Business License - $44 for the first year, $29 for renewals
General Business Licenses are issued to businesses with a physical location within the Town Limits based on compliance with Zoning Information. All businesses based in the Town of Paradise or providing services to Paradise residents or businesses require a General Business License except for the following, which are exempt:
- Libraries – public and private.
- Agriculture – includes growing of crops or raising livestock, except that a General Business License is required for any enterprise that combines product from multiple farms, wholesale, etc.
- Businesses located outside Paradise that deliver to Paradise addresses but provide no other service.
- Service Clubs
- Nonprofit Organizations with no paid employees or physical place of business.
- Vendors at community events.
- Residential rental properties with no more than one unit
- Persons exempt from business license fees pursuant to federal or state laws
Home Based Business – No Fee
Running a business from home is an attractive idea to many people, but it is important for home business operators to remember that they are conducting a business in a home, which is most likely surrounded by other homes in a residential area. The Town places certain restrictions on the operation of home businesses to protect the residential nature of the neighborhood and prevent nuisance complaints regarding noise, dust, and traffic. These rules protect you and your neighborhood, and ensure that the primary use of the homes is for residential purposes only.
Special Business License - Cost varies
Certain types of businesses are required to have more than one license. Usually the second license is a Special License. Note: you may require additional licensing from other governmental agencies in addition to your Town of Paradise License. The special License is issued based on a review of the application and may require approval by the Police Department, fingerprinting and background checks.

Fire

Emergency personnel are on staff 24/7 and can be dispatched by calling 9-1-1. If you need to contact our administrative office (530) 872-6264, Station 81 is at 767 Birch Street. Hours are Monday through Friday from 9:00 a.m. to 1:00 p.m.

Burn season runs from the fall as approved by the Fire Chief through May of the following year. Beginning July 1st of the current year, a new permit will be required for burning. The permit will remain valid during burn season until June 30th of the following year. Along with a valid permit, citizens must contact Butte County Air Quality Management District to ensure that it is a permissible burn day; if burning is suspended due to fire hazard or air quality reasons it will be reflected in the recording. The cost of a Residential burn permit is $25.00, Fuel Reduction burn permit is $54.91.

The Chipper Program is administered by Butte Fire Safe Council through grant funding. The program is free, provided you meet the requirements. For more information, visit their website at https://buttefiresafe.net/chipper-program/.

We appreciate citizens being concerned with fire safety. During fire season we will follow up on all fire hazard complaints. Please contact Paradise Fire & Rescue at (530) 872-6264 or email defensiblespace@townofparadise.com and provide the site address and your concerns. Our Fire Prevention Inspector will visit the site personally and follow up with the property owner.

Homeowners insurance companies frequently request that individuals provide the Insurance Service Office (ISO) rating or the ISO Public Protection Classification which gauges the fire protection capability of your local jurisdiction. The entire Town of Paradise is currently an ISO-2/2X.

Broom is highly flammable and, for fire safety, eradication of this plant is encouraged, but not currently required as long as it does not present a fire hazard as outlined within the California Government Code § 51182 and Paradise Municipal Code 8.58 Defensible Space and Hazardous Fuel Management.

As one might imagine, there is both a cost and a liability involved in dispatching fire staff to reach high, out of the way smoke detectors. Citizens are encouraged to make arrangements with a family member, friend, or contractor to maintain personal fire safety equipment.
Please note that a regular 9-Volt battery operated smoke detector has an 8 to10 year life span. Effective July 2014, when purchasing a smoke detector it should have a date stamp on it, and an encased lithium or long-life battery in it designed to last up to 10 years; when the smoke detector beeps, a new unit needs to be purchased.

Paradise Fire & Rescue does not service fire extinguishers, but there are several private companies in the area that do. Please consult your local telephone book. For disposal of old fire extinguishers, please contact Northern Recycling & Waste Services.
Measure C

It is the Town’s responsibility to provide public services that benefit our community – things like police protection, fire suppression, emergency medical services, street maintenance and road repairs, animal control and shelter services and other necessary services that benefit all Paradise residents and visitors. Maintaining these public services isn’t cheap. In particular, the great recession of the last few years has impacted the Town’s budget resulting in nearly 3.8 million dollar loss. While the economy is showing modest signs of improvement, property taxes, which represent 46% of the Town’s income, are capped at 2% growth per year and it is projected that it will take us about 6-7 years to get back to pre-recession revenues.

Police
Over the past six years Paradise Police have been stretched extremely thin. The department needs adequate staffing in several critical areas in order to keep pace with changes in crime patterns. There are currently 4 frozen Police Officer positions and 2 Sergeant Positions. Statistically, crime in our area is increasing. The Department’s Police cars average 9.7 years old, which is beyond the recommended service life. Public safety remains a top priority in the allocation of general funds, however without additional revenues, services and vehicle replacement will be affected.
Fire
Town of Paradise Fire Stations are aging and need many serious repairs. First response fire engines are 6, 12, and 13 years old and reserve engines are over 20 years old. Without additional monies, there are no funds available for replacement.
Road Maintenance
The Town has about 100 miles of roads to maintain. Bringing all roads to an acceptable condition would cost about $32 million dollars. Obviously, the current budget does not come close to allowing the Town to address even the most critical needs. New tax revenue money coupled with State and Federal Grant funding would allow the Town to implement an improvement plan to bring roads closer to an acceptable standard over time.
Animal Control
Measure N passed by voters in 2004 funds about $131,000 a year toward Animal Control and Shelter Services. To bring staffing levels and Shelter hours back to an adequate level, an additional $40,000 a year is needed.
Facilities
Town of Paradise facilities have grown old, deteriorated and in some cases are unsafe. The great recession of the last few years has impacted the Town’s budget, making it impossible to fund needed repairs and upgrades to aging facilities, while still maintaining critical services for the community.

A citizen oversight committee, established by the same local law proposing the sales tax (Ordinance no. 545), will review the spending of tax revenue. The committee will consist of a 9 member board of residents and business owners of the Town of Paradise. The purpose of the committee is to provide independent recommendations and assist in monitoring and reporting of spending of tax monies. The committee will meet at least quarterly as well as at budget preparation time with the Town Manager and Finance Director to ensure that the funds are appropriately allocated. All quarterly and yearly budget reports from the committee will be published on the Town of Paradise website prior to Council adoption and will be available for public review.

Not much! The average household would pay less than $30-$50 per year during the six year duration of the sales tax. A sales tax does not overly burden Paradise residents, non Paradise residents who use Town services, such as roads, would also contribute. On a $100 taxable purchase, this would add on only 50 cents for the shopper. Here is an example of how an average family’s bill would change if Measure C is approved:

A ½ cent sales tax would raise about $850,000 per year. All funds generated by the local sales tax would be locally controlled and would stay in the Town of Paradise to provide essential public services. By law, the State could not take this funding away.

A local sales tax would apply to the same goods and services and be subject to the existing State sales tax on tangible personal property. For example, furniture, cars, giftware, toys, antiques and clothing would be subject to the tax. Items that are exempt from the sales tax include most groceries and prescription medicine.

Zoning

Each zoning district has unique minimum setback requirements and the answer depends on the zoning district in which your property is located and whether or not additional setbacks were recorded as part of a recorded parcel map or subdivision map that created your lot. Contact Planning Division staff to discuss setback restrictions on your property.

There are no building permits required for fences; however, there are limits to height and placement. A solid fence up to 6’ in height above grade can be installed along property lines that do not front a street. For the property line(s) that front a street, any portion of a solid fence within the street setback (typically 50’ from centerline of a public road and 30’ from centerline of a private road) can only be 4’ in height. Open chain link and/or wrought iron fences up to 6’ in height can extend into the street setback area. Only noncombustible fencing materials are allowed within 5' of a structure. No fence can be installed within a private road easement without written consent from ALL property owners who have legal right to that easement.

Under the residential zoning regulations, certain types of businesses may be conducted from a residence with a Town-approved Home Occupation Permit. To determine if your proposed business will qualify as a Home Occupation, please contact Planning Division Staff.

Under the residential and community services regulations, a small family day care with six or fewer children under the age of 10 (including the children who reside at the residence) is a permitted use. Caring for seven to fourteen children is a regulated use subject to the issuance of a Large Family Day Care Home permit, state licensing, and limited to specific zoning districts.

Up to two hens may be kept and raised upon residentially zoned property. The hens must be confined within pens, coops or other fenced areas that are at least 75’ away from any neighboring house.

In most residential zoning districts the keeping of anything more than cats, dogs, or two hens and two rabbits requires a Town-approved permit for “Animal Production/Livestock” which is based on acreage. To determine if your property qualifies for livestock animals, please contact Planning Division staff.

The temporary (9 months per calendar year) raising of livestock animals as a student animal project sponsored by the Future Farmers of America, 4-H, or similar organization on properties within all zoning districts is permitted solely in association with an established residence. There are minimum acreages required per animal as well as a maximum number of animals permitted. Please contact Planning Division staff to determine if your property is large enough.

Generally, the residential zoning districts potentially allow for a “Secondary Dwelling” (750 sq ft or less) with the issuance of a planning permit contingent on meeting minimum development standards for things such as wastewater and casinofire protection. For two full-size dwellings, or a “Two-Family Residence”, typically a certain level of use permit is necessary which may require a public hearing. Alleged violations of the Town of Paradise Zoning Ordinance may be reported directly to the Code Enforcement Division. Complaints must be in writing and anonymous complaints are generally not accepted. The Town has a standard complaint form that can be filled out at the counter or a copy can be mailed or emailed to you to complete. Complainants should be able to provide the following information: address of the property where the violation is located; nature of complaint with as many details as possible; and name, address and contact phone number of complainant.
