Land Use Review (LUR)

Any time there's a change in use that affects the existing daily wastewater design flow or flow strength allotted for the subject parcel, a Land Use Review (LUR) is required for both residential and commercial properties.  The most common trigger for a LUR is bedroom addition followed by a secondary dwelling aka ADU.  A Septic Permit Application is used to apply for LUR with total fees of $284.34 at the BRC for Onsite Wastewater review and approval of proposed changes.  Once approved, you may then apply for an Upgrade/Alteration permit to bring the system to current code & meet the onsite wastewater system requirements.  

 

Residential design flows as maximum gallons per day (gpd) and minimum acreage requirements for standard treatment:
Mobile home   =     125 gpd (in parks only, on private land calc'd by bedrooms)
1  bedroom       =     150 gpd     =   0.17 acres     =   1500 sqft max
2 bedroom       =     225 gpd     =   0.25 acres    =   2200 sqft max
3 bedroom       =     300 gpd    =   0.34 acres    =   2900 sqft max
4 bedroom       =     375 gpd    =   0.42 acres     =   Max sqft limits are determined by overall building coverage allowed for subject parcel - see Planning
Each add. bd   =     +75 gpd     =   0.50 acres    
*Each dwelling on a property is calculated separately, not by combining total number of bedrooms.
 

Requirements to apply for a Land Use Review (LUR):

  1.  Septic Permit Application
  2.  Engineered Calculations*
  3.  Test Hole(s)**
  4.  Fees (Cash/Check/Credit Card)

*Commercial properties have additional requirements including engineered wastewater flows from a qualified specialist.  This may also apply to small lots and properties with poor soils. 
**Test Holes are required in areas with high ground water or poor soils.  Call Town staff to verify.
